Al respecto, mi posición va en contra del fallo del Tribunal Constitucional que declaró fundada la demanda de amparo y por ende nulas las Resoluciones emitidas por el Consejo Superior de Arbitraje y el laudo, retrotrayendo el proceso al momento de la designación del árbitro Jorge Vega Velasco. Ello, debido a que el Tribunal Constitucional no aplicó un criterio objetivo para poder determinar la supuesta parcialidad y dependencia del referido Consejo. Por el contrario, aplicó la teoría de la apariencia, sin basarse en indicios debidamente probados en sede constitucional. Para la finalidad de la presente investigación, los principales instrumentos empleados son la Ley General de Arbitraje, Directrices IBA sobre conflictos de intereses, Reglamento de Arbitraje del Centro de Arbitraje de la Cámara de Comercio de Lima, así como doctrina nacional e internacional sobre el deber de imparcialidad e independencia.

In this regard, my position goes against the ruling of the Constitutional Court that declared the amparo claim founded and therefore null and void the Resolutions issued by the Higher Arbitration Council and the award, taking the process back to the time of the appointment of arbitrator Jorge Vega Velasco . This is due to the fact that the Constitutional Court did not apply an objective criterion to be able to determine the alleged partiality and dependency of the aforementioned Council. On the contrary, it applied the theory of appearance, without basing itself on evidence duly proven in constitutional law.
