Esto, teniendo en cuenta que dichas instituciones, con independencia de su naturaleza, ejercen funciones administrativas en el marco de su actuación, lo cual puede dar origen a la imposición de barreras burocráticas pasibles de ser ilegales o carentes de razonabilidad. Para llevar a cabo el análisis, se tomará en cuenta, principalmente, el Decreto Legislativo 1033, el Decreto Legislativo 1256 y la Ley 27444. Asimismo, se utilizará jurisprudencia del Tribunal Constitucional y el Poder Judicial en la materia, y pronunciamientos de naturaleza administrativa. Finalmente, también se tomarán en cuenta posiciones doctrinarias relacionadas al tema bajo análisis. Todo ello nos llevará a concluir que los colegios profesionales, al ser instituciones que ejercen funciones administrativas, pueden imponer barreras burocráticas, por lo que se encuentran sujetos al régimen de prevención y eliminación de barreras burocráticas y a lo dispuesto en el Decreto Legislativo 1256. Sin perjuicio de ello, en virtud del análisis realizado, se brindará una propuesta de cambio normativo que permitirá la eficiencia de dicho régimen y que se disipen las dudas y discrepancias en torno a la aplicación del Decreto Legislativo 1256 a instituciones como los colegios profesionales.

This is based on the fact that such institutions, regardless of their nature, perform administrative functions within the scope of their operations, which may give rise to the imposition of bureaucratic barriers that could be illegal or lack reasonableness. To conduct this analysis, the study will primarily consider Legislative Decree 1033, Legislative Decree 1256, and Law 27444. Additionally, jurisprudence from the Constitutional Court and the Judiciary on the matter, as well as administrative pronouncements, will be utilized. Finally, doctrinal positions related to the issue under analysis will also be taken into account. All of this will lead us to conclude that professional associations, as institutions that perform administrative functions, may impose bureaucratic barriers. Therefore, they are subject to the regime for the prevention and elimination of bureaucratic barriers and to the provisions of Legislative Decree 1256. Notwithstanding this, based on the analysis conducted, a proposal for regulatory change will be presented.
