El presente informe realiza un análisis respecto a la Casación N° 2720-2019 emitida por la Sala Civil Permanente de la Corte Suprema de Justicia de Lima, la cual resuelve un recurso de casación interpuesto por la infracción normativa de los numerales 3 y 5 del artículo 139° de la Constitución Política del Perú, concordante específicamente con el numeral 2 del artículo 688° del Código Procesal Civil. El análisis se centra en lo resuelto por las instancias judiciales y lo que finalmente terminó por decidir la Corte Suprema sobre las actuaciones del juez y de las partes durante un proceso de ejecución laudo frente, a su vez, la tramitación de una acción de nulidad. Asimismo, se analizarán las defensas que la parte ejecutada puede realizar frente a un mandato ejecutivo que tiene por objeto el cumplimiento de las obligaciones contenidas en un laudo arbitral. Por último, se analizará los supuestos en que un laudo arbitral cuenta con la calidad de firme y si ello resulta necesario para ejecutar un laudo arbitral, conforme a las normas de nuestro ordenamiento jurídico. |

Por último, se analizará los supuestos en que un laudo arbitral cuenta con la calidad de firme y si ello resulta necesario para ejecutar un laudo arbitral, conforme a las normas de nuestro ordenamiento jurídico.This report analyzes Cassation No. 2720-2019 issued by the Permanent Civil Chamber of the Supreme Court of Justice of Lima, which resolves a cassation appeal filed for the normative violation of numerals 3 and 5 of article 139° of the Constitution of Peru, specifically consistent with numeral 2 of article 688° of the Civil Procedure Code. The analysis focuses on what was resolved by the judicial instances and what the Supreme Court finally ended up deciding on the actions of the judge and the parties during an award enforcement process against, in turn, the processing of an annulment action. Likewise, the defenses that the executed party can carry out against an executive order that has as its objective the fulfillment of the obligations contained in an arbitral award will be analyzed.
