Se desarrolló bajo un enfoque cualitativo, con diseño fenomenológico, nivel descriptivo-correlacional, utilizando como técnica el análisis documental y entrevistas a una muestra intencionada conformada por 3 fiscales y 3 abogados constitucionalistas. Los instrumentos fueron fichas de análisis y entrevistas semiestructuradas. Entre los hallazgos clave, destaca que el 52% de encuestados percibe abusos sistemáticos en los arrestos ciudadanos, mientras el 64% afirma que el marco legal no protege a los que los realizan, generando incertidumbre jurídica. Asimismo, un 59% indicó que el apoyo comunitario es esencial para la protección física del arrestador. La percepción sobre la ausencia de políticas de seguridad es preocupante: 67% considera que no hay respaldo institucional. No se aplicó estadística inferencial tipo “rho” o “Pearson”, al ser de naturaleza cualitativa. Se concluye que el arresto ciudadano, sin una regulación clara ni formación legal, tiende a convertirse en un medio de vulneración de derechos, más que de protección comunitaria.
