This article addresses the evolution of the category of femicide. It studies its birth in feminist theory, its translation and development in Latin American academia, its use in international law and its transformation into a crime. The analysis of the evolution of this concept allows highlighting its singular and autonomous character. Thus, the study of this category helps to strengthen the doctrine that defines femicide as the killing of a woman for gender reasons, that is, the killing of a woman in a context in which the victim failed to comply with gender stereotypes.

This paper identifies the interpretative and qualification legal problems posed by the criminalisation of rape offences in Peru by examining the most contemporary case law and specialised literature. Through a teleological and systematic legal interpretation of these offences and applying a gender perspective, preliminary alternative solutions are constructed. The main legal conclusion reached is that, with the incorporation of the modality of “taking advantage of any other environment that prevents the person from giving free consent” in the offence of rape in its basic modality (article 170 of the Criminal Code), the Peruvian legal system has incorporated a model based mainly on the absence of consent for sex offences. Durante mucho tiempo la sociedad ha sido construida a partir de un prototipo ideal de individuo racional, capaz de sentir, comunicarse y decidir sobre su vida sin algún tipo de asistencia. In this sense, the strengths and weaknesses of the following proposals are analyzed: freedom, dignity, moral integrity, multi-offensiveness and legal personality.
