                  La connotada autora desarrolla en este artículo la distinción entre los servicios Públicos asistenciales –o servicios Públicos “sociales”– y los servicios Públicos económicos, de cara a entender cuándo es que el estado incurre en competencia desleal e infringe el principio de subsidiariedad. Para ello, comenta fallos de INDECOPi, que se originaron gracias a casos emblemáticos como “Universidad del altiplano: pollos a la brasa” y “Clínica santa teresa”. Finalmente, recalca la importancia de diferenciar entre aquellas actividades estatales que tienen una naturaleza empresarial y aquellas otras, que dada su esencialidad, no deben regirse por criterios de mercado, sino de universalidad, equidad y asequibilidad.

                  The Peruvian Government decided to use Public-Private Partnerships as a tool in its infrastructure policy. However, the constant amendments to the legal framework, the delays in the execution of projects and the frequent addend to concession contracts (specifically, those which are co-financed) have created distrust in society and affected the credibility of this model.This article analyses the main causes foref renegotiation of concession contracts awarded by ProInversión and the derived costs of excessive renegotiation. Our data shows that the benefits that the Peruvian Government obtains by acting opportunistically: i.e., by awarding projects that lack sufficient studies or an adequate risk assignment, are countered by the impact on the legitimacy of Public-Private Partnerships and by the delays in the completion of projects destined to attend public&nbs...

                  Muchas veces el régimen de los Servicios Públicos se puede encontrar definido respecto a coyunturas económicas y políticas, en gran parte, lejanas a criterios técnicos y jurídicos. De otro lado, es un denominador común el discurso por el cual se señala que los modelos adoptados respecto a la prestación de los servicios deben responder a promover objetivos tales como la competencia y la libertad de gestión empresarial, ello muy acorde con una regulación estatal justa y necesaria, que garantice finalmente el interés público, sin sustituir la iniciativa privada. Existen, sin embargo, grandes inquietudes y temas aún por discutir sobre este polémico asunto, los cuales motivaron y dieron pie a esta mesa redonda que convoca como panelistas a figuras representativas de diversos sectores con amplia experiencia en el tema.
