El presente informe jurídico analiza el Expediente No. E-2765 del proceso arbitral No. 2879-2014-CCL iniciado por Latintecna S.A., una empresa contratista, contra Repsol Exploración Perú S.A. – Sucursal Perú, operador del Lote 57. El caso gira en torno a una controversia en el marco del contrato “EPC Llave en Mano y Puesta en Marcha para el Proyecto Kinteroni”. Latintecna presenta una demanda arbitral solicitando se le reconozca una prórroga al plazo contractual y el pago de costos adicionales. Por su parte, Repsol presenta una demanda reconvencional contra Latintecna y solicita se incorpore al arbitraje a la empresa Tecna Estudios y Proyectos Ingeniería S.A. (empresa matriz de Latintecna). Repsol solicita se reconozca que Latintecna y Tecna incumplieron sus obligaciones, por lo cual le adeudan una serie de montos bajo conceptos de indemnización y penalidades contractuales. ...

The exponential growth of e-commerce in Peru has generated new problems in the effectiveness of consumer rights and the consequent consumer distrust in e-commerce transactions. Government authorities have repeatedly mentioned that a solution to these problems would be the regulation of electronic consumer’s relationships established at national level. This solution goes on the same page with the tendency of the European Union to regulate digital markets. However, is the legislative initiative an ideal solution to solve the new problems generated by e-commerce?.In this article, the authors find that regulation of e-commerce would not completely solve the new problems generated by it.
