This paper explores the coexistence of homonymous geographical indications (GIs) in the absence of explicit internationally harmonized provisions regulating this issue in general. It aims to identify the challenges or problems arising from such coexistence and to delineate the conditions under which it might be allowed, while maintaining a balance among the interests of producers, consumers, and States (public interest). To achieve this, the paper conducts an inductive analysis of the coexistence of the homonymous GI for grape distillates: “Pisco”, claimed by both the Republic of Chile and the Republic of Peru. This analysis has revealed these three challenges arising from the coexistence: a) consumers’ confusion, b) ambiguous international protection, and c) erosion of the GI’s economic value as a marketing tool, which may give rise to other problematic consequences. El presente artículo gira en torno al debate y aclaración de la situación y parámetros de registrabilidad de las actualmente llamadas "Marcas No Tradicionales", las mismas que -al igual que las Marcas Tradicionales- están destinadas a distinguir productos y/o servicios en el mercado, pero son percibidos por el consumidor a través de sus otros cuatro sentidos distintos al de la vista.

In this paper, the relationship between unfair competition and intellectual property regulation will be analyzed, focusing on the application of Article 137 of Decision 486. Hence, firstly, bad faith and unfair competition as unregistrability provisions of trademarks will be conceptually analyzed; secondly, the application in Colombia, Ecuador, Bolivia, and Peru in the last years of said Article will be assessed; and, thirdly, the pre-judiciary interpretations issued by the Court of Justice of the Andean Community will be reviewed. Considering the above, it can be concluded and established the "jurisprudential requirements" for the application of Article 137 of Decision 486; as well as, the challenges faced by the owner of an intellectual property right to activate its application.
