The theory of the sanction, its purposes and the general object of the criminal legal system, have always brought substantial questioning by the dogmatic penitentiary, that is why its legitimacy has been questioned, for the lack of better arguments. It is in this background that the teacher Eugene Raul Zaffaroni from Argentina, sets out certain positions by which he questions the entire Latin American criminal system. In this context, began the debate with criminal attorney and well known philosopher of law Carlos Santiago Nino. It seems to us very interesting to know the points of divergence as well as the conformities between both. That is the reason for the present work, which is presented as guide for further discutions and developments.

La presente investigación tuvo como objetivo determinar si la derogación de la potestad nulificante de los jueces de apelación afecta al debido proceso. La investigación fue aplicada, con enfoque cualitativo y alcance descriptivo-exploratorio, siendo su diseño de teoría fundamentada emergente. La recolección de datos se efectuó mediante una guía de entrevista estructurada validada por seis jueces expertos y aplicada a una unidad de análisis conformada también por seis expertos, tres de ellos jueces del Poder Judicial y tres juristas. El análisis de los resultados permitió concluir que en el escenario aludido no se afectaría el debido proceso debido a que los jueces de apelación siempre pueden contar con el instrumento constitucional del control difuso aplicable ante la lesión de cualquier derecho fundamental por normas de menor jerarquía que la Constitución Política de...
