La presente investigación tuvo como objetivo determinar si la derogación de la potestad nulificante de los jueces de apelación afecta al debido proceso. La investigación fue aplicada, con enfoque cualitativo y alcance descriptivo-exploratorio, siendo su diseño de teoría fundamentada emergente. La recolección de datos se efectuó mediante una guía de entrevista estructurada validada por seis jueces expertos y aplicada a una unidad de análisis conformada también por seis expertos, tres de ellos jueces del Poder Judicial y tres juristas.
