El presente artículo tiene como objetivo principal mostrar, desde una perspectiva constitucional, el proceso de formación del régimen económico peruano y su actual orientación hacia una economía social de mercado, modelo que se sustenta en la doctrina social de la iglesia. En el desarrollo del presente artículo, se analiza la posición institucional del Congreso de la República en el sistema constitucional peruano. Para ello, se explica en qué consiste el principio de democracia representativa y sus características principales en los sistemas de representación “unicameral” y “bicameral” del Congreso de la República. Posteriormente, se analizan los proyectos de ley que proponenrestituir el sistema bicameral en el Congreso actual y se exponen los posibles efectos jurídicos y políticos que podría causar su retorno en la política peruana actual.

The purpose of this article is to analyze the figure of impeachment regulated in the Constitution of Peru of 1993 and developed by the subsequent jurisprudence of the Constitutional Court. We maintain that the Constitution has provided for offending conducts and in that order we identify, specifically, the types of constitutional offense that can give rise to a sanction, which we call the “constitutional types”. For this reason, we state that the trial is political due to the nature of the organ that carries it out, but not because it can be resolved with merely political criteria, rather than on the contrary, the demands of the democratic State impose respect for principles such as legality or due process.
