El objetivo general es determinar el impacto de la inteligencia artificial en el derecho de autor en el Perú y proponer un marco normativo adecuado que garantice un equilibrio entre la protección de los derechos patrimoniales y morales de los autores y el fomento de la innovación tecnológica, con los avances realizados en la IA. Esta investigación sigue un enfoque cualitativo, con un diseño descriptivo‑analítico. Para recolectar los datos se emplearon entrevistas semiestructuradas a cinco abogados especialistas en derecho civil de la ciudad de Trujillo, cuyas respuestas fueron comparadas y contrastadas con el marco teórico y los antecedentes jurídicos relacionados con la inteligencia artificial y el derecho de autor en el Perú. Asimismo, se realizó un análisis documental del Decreto Legislativo N.º 822 y demás normativa vigente en materia de propiedad intelectual. La interpretación de los resultados permitió identificar vacíos normativos, deficiencias procedimentales y proponer reformas legales específicas para incorporar disposiciones claras sobre la autoría algorítmica, la transparencia en el uso de IA y los mecanismos de supervisión institucional. Se concluye que la normativa peruana actual en materia de derecho de autor presenta deficiencias significativas al no contemplar expresamente las obras generadas con inteligencia artificial, lo cual genera incertidumbre jurídica y limita la protección de los derechos patrimoniales y morales de los autores y desarrolladores. En particular, la falta de criterios operativos para evaluar la autoría mixto–humana y algorítmica impide un reconocimiento claro de las contribuciones de ambas partes y deja vacíos en los procedimientos de registro y fiscalización de obras con IA. Además, los mecanismos de supervisión institucional de Indecopi no están adaptados al seguimiento del uso de IA en la creación de contenidos, y no existen sanciones ni directrices específicas sobre transparencia en los procesos algorítmicos. En consecuencia, se acepta la hipótesis general de que la regulación vigente necesita ajustes legislativos para incorporar disposiciones claras sobre autoría algorítmica, transparencia en el uso de IA y mecanismos de supervisión y sanción, de modo que se garantice un equilibrio entre la promoción de la innovación tecnológica y la protección efectiva de los derechos de autor.

The overall objective is to determine the impact of artificial intelligence on copyright in Peru and propose an appropriate regulatory framework that guarantees a balance between the protection of authors' property and moral rights and the promotion of technological innovation, with the advances made in AI. This research follows a qualitative approach, with a descriptive-analytical design. Data were collected through semi-structured interviews with five civil law attorneys from the city of Trujillo. Their responses were compared and contrasted with the theoretical framework and legal background related to artificial intelligence and copyright law in Peru. A documentary analysis of Legislative Decree No. 822 and other current intellectual property regulations was also conducted. The interpretation of the results made it possible to identify regulatory gaps and procedural deficiencies, and to propose specific legal reforms to incorporate clear provisions on algorithmic authorship, transparency in the use of AI, and institutional oversight mechanisms. The conclusion is that current Peruvian copyright regulations present significant deficiencies by not expressly considering works generated with artificial intelligence, which generates legal uncertainty and limits the protection of the property and moral rights of authors and developers. In particular, the lack of operational criteria for evaluating mixed human and algorithmic authorship prevents clear recognition of the contributions of both parties and leaves gaps in the procedures for registering and supervising works with AI. Furthermore, Indecopi's institutional oversight mechanisms are not adapted to monitoring the use of AI in content creation, and there are no specific sanctions or guidelines on transparency in algorithmic processes.
