description El presente trabajo de tesis ha presentado como objetivo general “analizar los fundamentos jurídicos que justifican la necesidad de establecer la presunción de paternidad en las Uniones de Hecho”. En base a ello, se empleó un régimen metódico de enfoque cualitativo, descriptiva, y para adquirir información se utilizó la aplicación de una entrevista y de análisis documental; siendo la entrevista aplicada a 25 profesionales de derecho y analizando 10 jurisprudencias referentes al tema de estudio. En base a ello, se concluyó que, la ausencia de normativa sobre la atribución de paternidad en convivencias no matrimoniales produce serias repercusiones jurídicas, sociales y económicas, impactando principalmente a los menores, quienes sufren violaciones a derechos esenciales como la identidad, la filiación y la salvaguarda social. La falta de certeza legal que surge sobrecarga el sistema judicial y provoca inequidades en la implementación de la justicia, mientras que la falta de un reconocimiento jurídico del padre repercute de manera adversa en la estabilidad financiera y emocional de las familias

Based on this, a qualitative, descriptive approach was used to gather information, using interviews and documentary analysis.
