La presente investigación denominada “LAS NORMAS DE LA RESPONSABILIDAD CIVIL EXTRACONTRACTUAL Y SU EFICACIA COMO INSTRUMENTO JURÍDICO PARA LA PREVENCIÓN, PROTECCIÓN Y CONSERVACIÓN DEL AMBIENTE”, tiene como objetivo determinar si las normas de la responsabilidad civil extracontractual son eficaces como instrumento jurídico para la prevención, protección y conservación del ambiente. El cual es un tema relevante para la sociedad y sobre todo el ambiente que se ve desprotegida por no contar con una adecuada regulación normativa en nuestra legislación. Para la investigación realizada, se ha analizado la problemática social que se vive respecto al daño ambiental de acuerdo a sus entes reguladores. Como principal normativa tenemos la Ley General del Ambiente N° 28611 y Las Normas de la Responsabilidad Civil Extracontractual contenidas en nuestro Código Civil Peruano. Durante el proceso de elaboración del presente trabajo se pudo identificar puntos muy importantes dando respuesta a nuestro problema planteado, apoyados con los resultados obtenidos. Para la realización y análisis de esta investigación se utilizaron los métodos científicos y jurídicos, los cuales nos permitieron su desarrollo. |

Which it is an important issue for society and especially the atmosphere which is unprotected by not having adequate normative regulation in our legislation. For research, we analyzed the social problems that exists with respect to environmental damage according to their regulators. As the main rules have the General Environmental Law No. 28611 and the rules of the Tort Liability contained in our Peruvian Civil Code. During the preparation of this work could be identified very important points raised in response to our problem, supported by the results.
