La presente investigación denominada “Anulabilidad del matrimonio infantil regulada en la disposición complementaria transitoria única de la Ley N° 31945 y su impacto en la costumbre del servinacuy, Perú 2023” tiene como objetivo principal determinar de qué manera la anulabilidad del matrimonio infantil regulado en la Ley N°31945 impacta en la costumbre del servinacuy, Perú 2023. En relación al problema planteado, se formuló la siguiente pregunta: ¿De qué manera la anulabilidad del matrimonio infantil regulado en la Ley N°31945 impacta en la costumbre del servinacuy, Perú 2023? Asimismo, en cuanto a la hipótesis, se propuso el siguiente: La anulabilidad del matrimonio infantil regulado en la Ley N° 31945, establecida en su Disposición Complementaria Transitoria Única, impacta positivamente sobre la costumbre del servinacuy; siendo que, dicha Ley permite proteger a los menores de edad de matrimonios prematuros que pueden afectar su desarrollo físico, emocional y educativo, refuerza los derechos de las niñas y adolescentes, promueve el bienestar y el desarrollo integral y ayuda a frenar situaciones de abuso y explotación infantil, ya que los matrimonios de menores en la costumbre del servinacuy a menudo se encuentran vinculados a contextos de vulnerabilidad. En cuanto a la metodología, se utilizaron varios métodos, tales como: dogmático, axiológico, comparativo, analítico-sintético, exegético, sistemático e inductivo. Por otro lado, se aplicó la técnica del acopio documental y la entrevista, el cual permitieron conocer las consideraciones y/o posturas sobre el impacto de la anulabilidad matrimonio infantil regulado en la Ley N° 31945 en la costumbre del servinacuy. |

Regarding the research problem, the following question was formulated: How does the annulability of child marriage regulated under Law No. 31945 impact the custom of servinacuy in Peru, 2023? Likewise, the proposed hypothesis states that the annulability of child marriage regulated under Law No. 31945, as established in its Sole Transitory Complementary Provision, has a positive impact on the custom of servinacuy. This is because the law protects minors from premature marriages that may affect their physical, emotional, and educational development; it strengthens the rights of children and adolescents, promotes their well-being and comprehensive development, and helps to curb situations of abuse and child exploitation, given that early marriages within the servinacuy custom are often linked to contexts of vulnerability. As for the methodology, several methods were employed, including the dogmatic, axiological, comparative, analytical-synthetic, exegetical, systematic, and inductive methods.
