Además, se examinan problemas secundarios sobre la competencia para determinar el rechazo de la CDC y la validez de interpretaciones implícitas de dicho rechazo. Los instrumentos normativos empleados incluyen los artículos 132,133 y 134 de la Constitución, el reglamento del Congreso, la ley N° 31355, los cuales regulan la CDC y su procedimiento. Además, se consideraron sentencias previas del TC que abordan la interpretación y los límites de este mecanismo, como la Sentencia 00006-2019-CC/TC, 0006-2018-PI/TC y la Sentencia 00006-2003-AI/TC. Las principales conclusiones indican que el planteamiento de la CDC por el Ejecutivo con el objetivo de conseguir la aprobación del PL 3570/2022-PE fue irregular y vulneró las competencias del Congreso. Se concluye que el Congreso tiene la competencia para determinar el rechazo de la CDC y que tal rechazo debe ser explícito para evitar interpretaciones arbitrarias. El fallo resalta la necesidad de respetar la separación de poderes y los límites constitucionales establecidos para preservar el equilibrio democrático en el país.

The main issue revolves around whether this vote of confidence constituted an irregular exercise of Executive powers and undermined the constitutional powers of the Congress. Additionally, secondary issues regarding the competent authority to determine the rejection of the vote of confidence and the validity of implicit interpretations of such rejection are examined.
