Asimismo, se habla de la naturaleza de la indemnización establecida en el artículo 345-A del Código Civil, resaltando que es una medida para compensar el desequilibrio que sufre el cónyuge culpable, mas no una reparación civil. Además, se sostiene que el Pleno refuerza la protección del cónyuge vulnerable, pero puede existir posibles barreras procesales por los requisitos que esta exige. Finalmente, se propone la necesidad de un Código Procesal de Familia que adecue por especificidad y adecuación del derecho material las normas procesales generales.

The study examines whether the flexibility of procedural principles in family law cases modifies existing procedural regulations, concluding that such flexibility is necessary to ensure effective legal protection. Additionally, it discusses the nature of compensation under Article345-A of the Peruvian Civil Code, emphasizing that it serves as a measure to offset the imbalance suffered by the disadvantaged spouse rather than constituting civil liability. Furthermore,it argues that while the Precedent strengthens protections for vulnerable spouses, potential procedural barriers may arise due to its requirements.
