The due motivation for issuing decisions is the constitutional right of citizens to know the factual and legal reasons that the authorities and officials, especially those of the State apparatus, adopt to resolve claims, where their interests are included. This right is a component of the due process, also called fair process, an expression of effective procedural protection. There is a gender-to-species relationship between both concepts and, consequently, they are closely linked; therefore, undue motivation would be a flagrant violation of citizens’ rights. In this line of ideas, one constantly hears about the filing of appeals against decisions issued because citizens are not satisfied with them, one of the arguments being the lack of motivation, for allegedly having violated substantive and procedural guarantees in the course of the process. In some cases, the appeals are admitted ...

It shows an exercise whose objective is to get the students or participants to design the strategy they will follow during a negotiation process, taking into account the basic principles of a price negotiation. It simulates a typical negotiation between a buyer and a seller, each of whom has information that the other does not know. Each party must negotiate the price at which it will be willing to enter into the transaction. A second objective is to record the evolution of the negotiation process in order to measure the strength and sequence of the arguments, as well as the style of the negotiation. To this end, the instructor's guide suggests that the participant should define his strategy, prepare the arguments with which he will support it and define his negotiation style.

This article details the process that was carried out for the salary forecast in a database of a census given in 1996, where the Python programming language was used, for the analysis of the data of the dataset the Google Colab server was used to execute the algorithms in the cloud, since the team considered that the speed of data analysis in Google Colab is faster. One of the data mining techniques was also used to classify the variables using decision trees that have the ability to graphically represent several alternative solutions in order to determine the most effective courses/routes of action for the classification of the obtainment. of a person's salary.

Finance, as an area of knowledge derived from the economic sciences, is developed so that the users of the information can make three important decisions for the sustainability of companies. The first one deals with investment decisions, which seek to maximize benefits and minimize costs, which, when compared to the total investment and the cost of resources, should generate added value for the organization. To this end, companies must carefully choose the investment options, selecting those that are most likely to generate a return, always within the level of risk that the shareholder can tolerate and understanding that there is also a level of uncertainty that must be considered when determining the desired profit margins or opportunity cost. The second decision, a variable in this research, deals with the cost of resources and the means by which organizations obtain the cash flows they...

In manufacturing processes, there are conditions that continually impact decision-making among when choosing among alternatives; the selection is usually influenced by critical aspects such as quality, productivity, costs and customer feedback, among others. This article analyzes different adhesives for the process of gluing parts for sports shoes in a company located in the city of Purisima del Rincon in Guanajuato, México. The analysis employs statistical engineering tools and an Analytic Hierarchy Process (AHP) methodology. The case studied deals with an issue with gluing parts. The glue currently employed is of good quality but has drawbacks such as its high cost and thickness, which leads to a time-consuming manual application, affecting productivity. We propose and apply an AHP model with input information obtained by means of industrial experimentation in order to select the best...

This paper provides an overview of the recent amendment to the Peruvian Code of Constitutional Procedure on the constitutional procedure of habeas corpus in cases of violation, threat or restriction of personal liberty in the context of criminal proceedings. An a contrario sensu interpretation of Law No. 23506 and its complementary law has established that habeas corpus would be applied in the case of irregular procedures, although the law does not explicitly state this. Consequently, in order for habeas corpus to be valid, the irregular procedure had to be directly related to the violation of constitutional guarantees such as due process and effective judicial protection, and this violation had to affect, threaten or limit personal liberty. The absence of an explicit rule led the Code of Constitutional Procedure to state textually that habeas corpus proceedings may be brought against fi...

Purpose: This paper aims to provide empirical evidence for using the prospect theory (PT) basic assumptions in the Argentine context. Mainly, this study analysed the financial decision-making process in students of the economic-administrative academic area of two universities, one public and one private, in Córdoba. Design/methodology/approach. The analysis methodology included (1) the descriptive statistical analysis to identify the presence of the certainty, reflection and isolation effects; (2) the construction of a set of indicators on the application of the PT; (3) the chi-squared independence test, to determine if the decisions made are independent of the degree course taken; (4) the non-parametric Kruskal–Wallis test, to determine if the decisions made by individuals vary according to the semesters taken or students' levels of progress; and (5) the non-parametric Mann–Whitney...
