This paper analyzes the case of the Brumadinho disaster, occurred in Brazil in 2019, which caused the death of 272 people, in addition to serious environmental damage. The Brazilian collective process system, formed predominantly by public institutions, responds with the prompt prosecution of collective actions, which resulted, in a period of two years, in three collective agreements. This article analyzes, through bibliographical research and primary data, the elements of the Brazilian collective litigation model that contributed to the success of the case and how they could serve as inspiration for other countries.

This paper analyzes the case of the Brumadinho disaster, occurred in Brazil in 2019, which caused the death of 272 people, in addition to serious environmental damage. The Brazilian collective process system, formed predominantly by public institutions, responds with the prompt prosecution of collective actions, which resulted, in a period of two years, in three collective agreements. This article analyzes, through bibliographical research and primary data, the elements of the Brazilian collective litigation model that contributed to the success of the case and how they could serve as inspiration for other countries.

In the first part of the article, a development for the concepts of provisional remedies and real or personal property bond and covering loss and damage, is proposed, under the Constitutional Court and our national doctrine view; as well as the scope of the first as a fundamental right, and second as a condition of execution. On the following part of the paper, the inclusion and the subsequent amendments to the article 159° of Tax Code is exposed, also its scopes and reasons. Finally, a possible modification of the article, that respect state´s raising goals and due process citizens’ right, is proposed.

Faced with increased demands for medical malpractice, there is the problem of identifying a strategy that addresses immedíate damage caused by errors or adverse events loc for healthcare practice. The report identifies 3 thesis, two already known: to establish insurance funds, and one that is based on the simple use of the budget allocated to health facilities, as indeed is often done, in many cases, though unofficially. The assessment of what happened in our reality, and an evaluation of the ethical, are used to determine the best strategy would be to use the budget as the other two more expensive health processes for administrative payments to the intermedíary in the case of insurance, or investment resources, in the case of funds and having to use the same time health workers to the respective health services. In this paper, the author states that every lawyer should be compelled to denounce before the corresponding bar association or the judge the cases of abuse of process that damages clients, so the (bad) lawyer, who is behind of these practices, can be punished. The author remarks the fact that, although judges and bar associations are the main protagonists in the punishment of abuse of process, the recognition of this lawyer’s duty can contribute to clients’ rights protection and the consolidation of rule of law. From this perspective, the author proposes that every abuse of process circumstance is perpetrated because a lawyer incited it or because he or she consented it; for this reason, a (bad) lawyer will always be the one who caused the abuse. El presente artículo desarrolla los conceptos de medida cautelar y contracautela, a la luz de lo resuelto por el Tribunal Constitucional y lo establecido por nuestra doctrina, así como los alcances del primero como derecho fundamental y del segundo como requisito de ejecución. De la misma forma, se analiza los alcances de la incorporación del artículo 159° del Código Tributario, mediante Decreto Legislativo N° 1121, y su modificatoria a través de la Ley N° 30230. Finalmente, se propone una posible modificación al mencionado artículo, de conformidad con los fines recaudatorios del Estado y el derecho a la tutela jurisdiccional efectiva de los administrados.

On November 25th, 2020, the Union adopted one of its most awaited legal instruments: the firstlegislation, that is supposed to create a European collective action mechanism for monetary relief. El trabajo de investigación gira en torno a relevar lo que acontecía en el ámbito normativo con la anterior regulación del artículo 630 del Código Procesal Civil que establecía la cancelación de pleno derecho de la medida cautelar cuando se obtenía una sentencia absolutoria para el demandando en primera instancia, aún cuando esta resolución no fuese firme, es decir, existiendo un proceso judicial en trámite.
