The aim of the article to demonstrate the necessity of a critical view on the construct of «competence» because of semantic and epistemic gaps. The analysis of the historical evolution of «competence» clarifies its origin and meanings. In this paper, we present a methodology for evaluating competing organizations in order to identify best practices among those organizations. We focus attention specifically on competitiveness in the context of a set of business schools for the purpose of identifying those that appear to be most efficient relative to their peers. One of the most widely recognized efficiency measurement methodologies is data envelopment analysis (DEA). DEA literature has witnessed the expansion of the original concept to encompass a wide range of theoretical and applied research areas, with one such area being network DEA, with two-stage DEA in particular. This latter concept and its extensions to multi-stage situations have been particularly influential in such settings as supply chain management. In the conventional two-stage serial model, it is assumed that in each stage efficiency will be defined by t...

The Law of Supression of Unfair Competition, approved by Legislative Decree 1044, tries to avoid confusions about what is protected as a trade secret and what cases of misappropriation should be sanctioned. In this article, the author questions the interpretation and application that has beenconsistently employed, in many cases, to some of the terms contained in the aforementioned law.For that purpose, the author explains the meaning of the trade secret and other related terms, such as prohibited competition and concurrent purposes. He then proceeds to elaborate an analysis about the economic function of protecting trade secrets and what should be the correct application of the Law of Supression of Unfair Competition.

Indecopi has within its functions the defense of free competition and the protection of intellectual property. This institutional design has the advantage of being able to see more clearly what are the points of convergence between the two subject-matter, harmonize them and achieve the goals they have in common. Within this convergence, there are sensitive issues as the granting of compulsory licenses. In this work, we highlight that compulsory licenses are exceptional measures and, to consider its granting, the State must have a procedure that provides confidence and predictability to citizens and clear definitions of what is meant by public interest, emergency and national security. Finally, it is proposed that the granting of compulsory licenses should be justified by a cost benefit analysis showing that is the best choice.

In the competition of the lighting market, LED technology has stood out for excellent characteristics, one of which is the possibility of dimming, compared to other technologies. The dimming capacity allows to find the comfort zone with respect to two parameters, illuminance and correlated colour temperature (CCT). The present work provides a methodology to find comfort with respect to two variables, the level of illumination and the CCT. A controller with a simple structure, supported by Arduino, is proposed to control the above-mentioned variables of LEDs. The LEDs are located on a tape attached to a heat sink. In addition, the use of a light box as an environment for analysis is proposed. The design of this cubicle is based on literature. The controller has the possibility to regulate 12 different channels and the linearity between the PWM output and the illuminance was verified. The ...

Compliance programs and systems of criminal or administrative liability are being increasingly adopted by different countries as measures meant to reduce the social cost of white collar criminality. However, the legal application of these measures does not always ponder correctly the impacts on common good, the levels of economic activity and the adequate functioning of markets of goods and services. Eventually, this situation can lead to undesired effects, such as the inefficiency of the criminal system, the reduction of economic activity or the arising of obstacles to competition. By taking these circumstances into account, in this paper we will utilize the Economic Analysis of Law to analyze the logic that inspires these legal institutes and the incentives they generate. Our objective is to delineate some parameters that allow legislators, judges, legal advisors and businessmen to eva...

With our article FLEXIBLE COST STRUCTURES TO OVERCOME THE GLOBALIZATION AND COMPETITIVENESS IN THE COMPANIES, presented in the journal QUIPUKAMAYOC Nº 33 we began an investigation to propose a model that incorporates the increasingly used strategy to achieve cost competitiveness in the market. Companies, with the new model of competitiveness that demands flexible production processes, are implementing business strategies in order to SPEED UP, SIMPLYFY and SECURE processes. Service companies are part of this strategy, which they are transferred functions or activities carried out within companies. But as we discussed in this article, SERVICE or OUTSOURCING costs can no longer be treated inside the other indirect costs of production (ICP) so we are looking for the fourth element, as a proposal to manage costs more accurately. This time, we will analyze various service contracts to underst...

The literature shows multiple bibliometric studies on business models across various sectors; however, little attention has been paid to the systematic analysis of academic production in tourism entrepreneurship. The business model in these ventures is a complex process involving sustainable practices and exchanging knowledge and resources within the entrepreneurial ecosystem. Entrepreneurs in tourism often have limited management and organisational capabilities due to an insufficient understanding of the components of business models and their interrelationships in fostering innovation and sustainability. This paper aimed to analyse the lack of unified definitions regarding business models in tourism entrepreneurship and provide guidelines for developing new models and managing existing ones. Through an analysis of 71 articles published between 2000 and 2022, 14 key components were iden...

The literature pays little attention to non-linear models, especially regarding dimensions such as organizational culture. Therefore, the purpose of this paper is to test the role of hierarchical distance in the relationship between HRM practices and social processes. With a sample of 102 Spanish firms and using partial least squares structural equation modeling assessed this relationship. Results suggested mediation of hierarchical distance between HRM practices and social processes. Such results recommend that HR managers should consider hierarchical distance more carefully especially when creating HRM practices to improve relationships among employees. Thus, the politics of commitment function better when organizations are more horizontal and when tasks are commonly delegated, managers question employees frequently prior to making decisions, discussions are encouraged, and social rela...

This research examines the effect of certain economic variables on the economic growth of the commercial sector in Ecuador during the years 2012, 2019, and 2022, by analyzing their impact on operating income in relation to the number of workers, gross capital formation, and intermediate inputs. To this end, the Cobb-Douglas production function is estimated using an econometric model initially estimated through Ordinary Least Squares (OLS) and subsequently corrected using Newey-West standard errors due to the detection of autocorrelation and heteroscedasticity in the initial results. For this study, data from the Superintendence of Companies, Securities and Insurance were used, paying special attention to characteristics such as company size and location. Among the main findings, it is observed that the number of workers and intermediate inputs are the most influential factors in the econ...

The current context of agribusiness is framed by three major drivers: business models based on bioeconomy and circular economy; mechanisms that ensure quality, safety, and traceability throughout the supply chain; and aspects of the Trade-Related Intellectual Property Rights (TRIPS) agreement. The latter has become a differential factor for both comparative and competitive advantage and is recognized as a potential enabler or constraint for the positioning of primary, minimally processed, and transformed agricultural products. In the case of Ocañera red onion as a primary product, access to distinctive signs covered by the TRIPS agreement, such as denomination of origin or geographical indication, would benefit the promotion of its cultivation, protect trade against homologous varieties from neighboring countries introduced without restriction, and facilitate the promotion of characteri...
