La presente investigación se realiza con el propósito de analizar la problemática del derecho a la muerte digna y los fundamentos que puedan motivar el desarrollo legislativo en el Perú a fin de reconocer el Derecho a Morir en condiciones dignas. Para esta finalidad se utilizó el método de investigación cualitativo, con diseño de la teoría fundamentada con la finalidad de evaluar los fundamentos jurídicos a favor y en contra del reconocimiento del derecho a morir en condiciones dignas, asimismo, se ha considerado como población y muestra a un conjunto de normas de la legislación y la jurisprudencia comparada que sirvieron como base para el análisis de los criterios fundamentales tanto desde el punto de visto filosófico como jurídico, los mismos que están vinculados al caso emblemático de Ana Estrada en el caso peruano. Se concluyó que la regulación respecto de la eutanasia tiene sustentos en criterios del derecho a la vida, toda vez que sus fundamentos jurídicos de acuerdo con la legislación comparada en países como Holanda, Bélgica, Canadá y España reconocen e identifican la importancia de garantizar un estado constitucional de derecho en aras de establecer leyes emitidas con la ayuda de entidades especializadas en medicina, las cuáles contribuirán con salvaguardar la autonomía de las personas para concluir con su vida en estado de padecimiento. |

For this purpose, the qualitative research method was used, with a grounded theory design in order to evaluate the legal foundations for and against the recognition of the right to die in dignified conditions, likewise, it has been considered as a population and shows a set of norms of legislation and comparative jurisprudence that served as the basis for the analysis of the fundamental criteria from both the philosophical and legal point of view, the same ones that are linked to the emblematic case of Ana Estrada in the Peruvian case.
