description El presente informe, aborda la sentencia del Tribunal Constitucional (en adelante, TC), recaída en el Expediente N° 03066-2019-PA/TC, el cual declara, por voto en mayoría simple, improcedente la demanda de amparo interpuesta por las comunidades campesinas, Chila Chambilla y Chila Pucara, en contra del Instituto Minero Metalúrgico (Ingemmet) y el Ministerio de Energía y Minas (MINEM), tras otorgar el título de concesión a la empresa minera Cemento Sur S.A.. En este sentido, se realizará un análisis integral de los hechos y el derecho que rodean al pronunciamiento emitido, a fin de desarrollar el reconocimiento del Derecho a la consulta previa en el bloque de constitucionalidad peruano.
