description La presente investigación aborda la naturaleza jurídica del trabajo penitenciario en el Perú de acuerdo a la realidad nacional. Así pues, se explica el trabajo penitenciario desde la doctrina y legislación desde el derecho comparado, se analiza los beneficios que existen por el trabajo y describe la forma en la que se desarrolla el trabajo dentro de los establecimientos penitenciarios del Perú. De acuerdo a nuestra legislación y normativas especiales, es considerado como un derecho y deber que tiene el interno; sin embargo, de acuerdo a la realidad penitenciaria se determina que el Estado no brinda los mecanismos necesarios, no cuenta con la infraestructura ni presupuesto necesario para que todos los internos puedan gozar de este derecho sin restricción, sobre todo por el hacinamiento carcelario; por lo que, podemos concluir que actualmente la naturaleza jurídica del trabajo penitenciario es ser un beneficio, porque solo ciertos internos pueden acceder y gozar de este derecho.

In this sense, the main objective of this article was to determine the legal nature of prison labor, whether it is a right or a benefit, based on the reality of penitentiary establishments. Thus, prision labor is explained from the perspective of the doctrine and legislation of comparative law, the benefits of prison labor in Peruvian penitentiary establishments, is analyzed the benefits that exist for work and describes in which work is carried out inside the penitentiary establishments of Peru. According to our regulation and special legislation, considered as a right and duty that the inmate has; however, according to the penitentiary reality it´s determined that the State doesn´t provide the necessary mechanisms, doesn´t have the infrastructure nor the necessary budget for all inmates can enjoy this right without restriction, especially due to overcrowding in prisons;
