Teniendo como objetivo general: “Demostrar que la procedencia excepcional del recurso de Casación Civil debe ser dotada de límites procesales para su aplicación, en el proceso civil vigente” Ahora, para poder llegar a este objetivo general, se propuso como objetivos específicos los siguientes: Dar a conocer la importancia de los límites a toda potestad judicial oficiosa en el proceso civil vigente; estudiar el desarrollo doctrinario de los límites procesales a la procedencia excepcional del recurso de Casación prescrita en el Código Procesal Civil; y, proponer algunos límites, vía una reforma legislativa, a la potestad judicial contemplada en el artículo 388 del Código Procesal Civil. Finalmente se arribó a la siguiente conclusión general: “La procedencia excepcional del recurso de Casación Civil debe ser dotada de límites procesales para su aplicación, en el proceso civil vigente, toda cuenta que de esta forma se estaría garantizando una adecuada potestad jurisdiccional oficiosa, la misma que resulta coherente con un proceso judicial dentro del marco de un Estado Constitucional de Derecho, además, teniendo en cuenta que contemporáneamente el ordenamiento procesal civil ha ido entendiendo que, incluso, el poder oficioso debe ser limitado, por tal razón, cuando se legislen límites a esta potestad oficiosa excepcional, se estaría siendo coherente con esta concepción jurídica”.

Having as general objective: ““Demonstrate that the exceptional origin of the Civil Cassation resource must be endowed with procedural limits for its application, in the current civil process““ Now, in order to reach this general objective, the following were proposed as specific objectives: Make known the importance of the limits to all informal judicial power in the current civil process; study the doctrinal development of the procedural limits to the exceptional origin of the Cassation appeal prescribed in the Civil Procedure Code; and, propose some limits, via a legislative reform, to the judicial power contemplated in article 388 of the Civil Procedure Code.
