Respecto a la metodología empleada, la investigación es básica, corresponde al nivel descriptivo, se utilizó como diseño de investigación la teoría fundamentada, el investigador optó por el enfoque cualitativo buscando comprender los fenómenos que se vinculan al saneamiento probatorio, haciendo una exploración según el punto de vista de la población de abogados laboralistas del Distrito Judicial de Piura y con una muestra de 8 participantes , arrojando como resultado que los operadores jurídicos manifiestan su deseo que se incorpore de manera taxativa el Saneamiento Probatorio en la Nueva Ley Procesal , concluyendo que la no regulación del saneamiento probatorio, afecta a las partes por cuanto mantienen incertidumbre al desconocer si los medios de prueba que ofrecen serán admitidas y valorados en sentencia, lo cual se sabrá hasta la emisión de dicha resolución, por otro lado y potencialmente el proceso podría verse afectado con nulidad si el juzgador uso como soporte de su sentencia un medio probatorio cuestionado.
