En ese sentido, consideramos pertinente que dicha causal sea desplazada, a fin de evitar que se transgreden derechos de carácter constitucional del supuesto cónyuge infractor, tales como: el derecho a la dignidad y el derecho a la identidad sexual-. En vista de ello consideramos que este tema es relevante para su debida investigación; toda vez que atentan contra los derechos que tiene el supuesto cónyuge infractor.

The affirmation described in the previous lines, is based on the fact that today this causal is not used with frequency. In that sense, we consider it pertinent that this cause be displaced, in order to avoid transgressing constitutional rights of the supposed offender spouse, such as: the right to dignity and the right to sexual identity.
