En tal sentido, se planteó como objetivo general: Determinar porque la colación, regulada en el Código Civil peruano, constituye un límite inadecuado a la potestad de disponibilidad de todo propietario, en la ciudad de Piura en el año 2022. Finalmente, después de haber analizado diversos aspectos relacionados con la problemática, se arribó a la siguiente conclusión: La colación, regulada en el Código Civil peruano, constituye un límite inadecuado a la potestad de disponibilidad de todo propietario, porque este no tiene fundamentos jurídicos objetivos para su existencia, antes bien, se fundamenta en aspectos absolutamente de índole moral, constituyéndose así en una frontera desproporcional a la propiedad que goza de reconocimiento legal, lo cual incluso atenta contra la libertad de disposición que todo propietario tiene respecto de sus bienes. Del mismo modo, la colación desincentiva el tráfico comercial de los bienes, que los herederos pugnen por construir su propio patrimonio; e, incentiva los conflictos judiciales y registrales sobre los bienes herederos objeto de tal colación.

In this sense, the general objective was proposed: Determine why the legitimate, regulated in the Peruvian Civil Code, constitutes an inadequate limit to the power of availability of every owner, in the city of Piura in the year 2022. Finally, after having analyzed various aspects related to the problem, the following conclusion was reached: Collation, regulated in the Peruvian Civil Code, constitutes an inadequate limit to the power of availability of every owner, because it has no objective legal foundations. For its existence, rather, it is based on absolutely moral aspects, thus constituting a disproportionate border to the property that enjoys legal recognition, which even threatens the freedom of disposition that every owner has with respect to his property.
