Además, el trabajo se nutre con las entrevistas realizadas a expertos en la materia constitucional y en el análisis estadístico de la política de vivienda en el Perú. Presentamos una visión crítica de la eficacia del derecho de la vivienda en el Perú, a partir de la jurisprudencia emitida por el Tribunal Constitucional y de la política de vivienda aplicada por el Estado Peruano. Concluimos que hasta el año 2021, existe una clara incongruencia entre la noción y el contenido que postula el Tribunal Constitucional, en relación a la naturaleza jurídica del derecho a la vivienda, en tanto carece de su principal característica: la garantía procesal. Por su parte, afirmamos que la política de vivienda en nuestro país adolece de un adecuado tratamiento. Razón por la cual, proponemos una reingeniería de la política de la vivienda

For this purpose, we use the dogmatic, functional and comparative methodology. In addition, the work is nourished by interviews with constitutional experts and statistical analysis of housing policy in Peru. We present a critical view of the effectiveness of the right to housing in Peru based on the jurisprudence issued by the Constitutional Court and the housing policy implemented by the Peruvian State.
