Representa el sentido de la investigación la falta de regulación de la manipulación intencional y dolosa de aquel centro de información que contiene información relacionada con el diagnóstico y tratamiento al que es sometido una persona, en circunstancias de encubrir una mala praxis médica; concretamente la falsedad deliberada de la historia clínica en actividades profesionales médicas constitutivas del delito de homicidio culpo, habiendo recurrido a bases doctrinarias y científicas que contienen argumentos válidos para su regulación como circunstancia agravante del citado ilícito penal; asimismo, se ha considerado respaldar los resultados con criterios objetivos recabados de profesionales especialistas en el quehacer jurídico dado la connotación eminentemente legal de la proyección y planificación del estudio, permitiendo sostener que los argumentos jurídicos que sustentará la falsedad de la historia clínica como agravante del homicidio culposo por actividad médica son: el Derecho de Acceso a la Información de servicios de salud y la Tutela jurisdiccional efectiva, ante la disyuntiva u interrogante por conocer ¿Qué argumentos jurídicos sustentará la falsedad de la historia clínica como agravante del homicidio culposo por actividad médica? Metodológicamente la investigación se sustenta en métodos relacionados con la recopilación de la información; así como en procedimientos específicos como técnicas y sus respectivos instrumentos de investigación, resaltando entre éstos últimos el cuestionario de entrevistas que acertadamente han proporcionados criterios objetivos y validos de especialistas que respaldan nuestros resultados. Los resultados arribados han sido discutidos y contrastados científicamente, permitiendo proponer como alternativa de solución la regulación de la falsedad de la historia clínica como agravante del delito de homicidio culposo por actividad médica, proponiéndose la modificación del código penal con la incorporación como agravante del delito de homicidio culposo por actividad médica a la falsedad de la historia clínica. |

Los resultados arribados han sido discutidos y contrastados científicamente, permitiendo proponer como alternativa de solución la regulación de la falsedad de la historia clínica como agravante del delito de homicidio culposo por actividad médica, proponiéndose la modificación del código penal con la incorporación como agravante del delito de homicidio culposo por actividad médica a la falsedad de la historia clínica.The meaning of the research is represented by the lack of regulation of the intentional and fraudulent manipulation of that information center that contains information related to the diagnosis and treatment to which a person is subjected, in circumstances of covering up medical malpractice; specifically the deliberate falsification of the clinical history in professional medical activities constituting the crime of negligent homicide, having resorted to doctrinal and scientific bases that contain valid arguments for its regulation as an aggravating circumstance of the aforementioned criminal offense; likewise, it has been considered to support the results with objective criteria collected from specialist professionals in the legal field given the eminently legal connotation of the projection and planning of the study, allowing to maintain that the legal arguments that will support the falsification of the clinical history as an aggravating circumstance of negligent homicide due to medical activity are: the Right of Access to Information on health services and the effective jurisdictional protection, before the dilemma or question to be known: What legal arguments will support the falsification of the clinical history as an aggravating circumstance of negligent homicide due to medical activity? Methodologically, the research is based on methods related to the collection of information, as well as on specific procedures such as techniques and their respective research instruments, highlighting among the latter the interview questionnaire that has accurately provided objective and valid criteria from specialists that support our results.
