description La motivación de resoluciones judiciales, es una de las garantías que tienen los justiciables, respecto de las posibles arbitrariedades que pudieran cometer los órganos jurisdiccionales que administran justicia, es decir, la norma constitucional con carácter imperativo, determina el deber de motivar que tienen los órganos de decisión. Siendo inevitable el deber de motivar, el magistrado que conoce un caso, donde se presenta una causa eximente de responsabilidad penal por anomalía psíquica, el antes mencionado –juez- tendría que argumentar, además, respecto de dos escenarios específicos, por el primero; “la no comprensión del carácter delictuoso de sus actos” y, por el segundo; “no determinarse según la comprensión, antes mencionada”, estas dos aristas mencionadas, inexorablemente tendría que argumentar el magistrado frente a estos casos en específico, En ese contexto se ha formulado como pregunta que sustenta la investigación la siguiente: “¿Existe una debida motivación de resoluciones en las sentencias que determinan inimputabilidad por anomalía psíquica emitidas en el proceso penal? Ante ese planteamiento del problema, se formuló como hipótesis la siguiente: “Existe una deficiente motivación de resoluciones judiciales en las sentencias que determinan inimputabilidad por anomalía psíquica emitidas en el proceso penal”. Esa incitada respuesta al problema, se ha comprobado de forma afirmativa, debido que, siendo una investigación descriptiva explicativa, se ha logrado vía el método doctrinario, analítico y hermenéutico, explicar que no existe una motivación según los estándares de la norma constitucional prescrita
