A través de un enfoque cualitativo y el método de análisis documental, se examinaron doctrina, jurisprudencia nacional y derecho comparado, evidenciando que la prescripción impide la depuración de actos nulos y genera incertidumbre en el tráfico patrimonial. El estudio demuestra que la nulidad absoluta, al proteger el orden público, no debe estar sujeta a prescripción, pues su aplicación consolida actos inválidos y dificulta la corrección de irregularidades en el sistema registral. En comparación con modelos jurídicos como el español, italiano y francés, se concluye que la imprescriptibilidad de la acción de nulidad absoluta es la opción más coherente con la estabilidad y legalidad del sistema jurídico. Se recomienda una reforma legislativa que elimine el plazo de prescripción para la nulidad absoluta, permitiendo que los jueces puedan declararla en cualquier momento y evitando que el orden público quede supeditado al transcurso del tiempo.

Through a qualitative approach and the method of documentary analysis, doctrine, national jurisprudence and comparative law were examined, showing that the prescription prevents the purification of null acts and generates uncertainty in property trafficking. The study demonstrates that absolute nullity, by protecting public order, should not be subject to prescription, since its application consolidates invalid acts and makes it difficult to correct irregularities in the registry system. In comparison with legal models such as Spanish, Italian and French, it is concluded that the imprescriptibility of the action of absolute nullity is the most consistent option with the stability and legality of the legal system.
