description Este trabajo de tesis está enfocado en la legitima defensa, con aplicación de la ley Stand Your Ground, ley estadounidense heredara de Inglaterra, el cual se centra en la defensa legitima frente a terceros que vulneren los bienes muebles e inmuebles de misma manera la integridad del afectado, quien tiene el derecho de usar la fuerza letal y ocasionar lesiones graves y hasta la muerte del agresor sin que sea enjuiciado la victima ya que esta actuó de la mejor forma para repeler la agresión ilegitima y así salvar su vida y/o bienes jurídicos. En Perú se planteó varios proyectos de ley proyecto de ley como uno de ellos tenemos al Proyecto de Ley 4409-2018-CR, propuesta por parte del congresista Jorge del Castillo, donde se pensaba aplicar dicha ley, el cual amplía la facultad del ejercicio de la legitima defensa y a la misma vez proporciona respaldo legal a la persona que trata de defender la inviolabilidad de su hogar o domicilio, vehículo y lugar de trabajo o empleo, generándole lesiones graves o la muerte al delincuente. El jueves 16 de mayo del año 2024 se publicó la Ley Nº32026 – Ley que modifica el código penal y el nuevo código procesal penal sobre los alcances de la legitima defensa, donde se menciona que no habrá prisión preventiva hacia la víctima cuando esta hiciera uso de la legitima defensa, agregando también que, si la persona hiciera uso de un arma de fuego inscrita legalmente a su nombre, esta será incautada durante 48 horas para las investigaciones correspondientes.
