description El presente trabajo de investigación denominado ““Fundamentos Constitucionales para la Reducción de la Edad de Imputabilidad en el Delito de Sicariato en el Perú““, tiene por finalidad determinar cuáles son los fundamentos jurídico- constitucionales que sustentarían la regulación de la imputabilidad penal desde los dieciséis años para el delito de sicariato en el Código Penal peruano. Asimismo, en cuanto a los objetivos, se propuso los siguientes: (i) analizar el tipo penal del delito de sicariato en la legislación nacional considerando la exposición de motivos respecto su trascendencia social, (ii) establecer los deberes primordiales del Estado desde el ámbito constitucional considerando como fundamento el desarrollo integral de la sociedad, (iii) explicar la facultad que la Constitución ha conferido al legislador de dictar leyes especiales por exigencia de la naturaleza de las cosas. Posteriormente, se formuló la hipótesis de la siguiente manera: ““Los fundamentos jurídicos-constitucionales que respaldarían la regulación de la imputabilidad penal a partir de los dieciséis años para el delito de sicariato en el Código Penal peruano incluyen el deber constitucional del Estado de proteger a sus ciudadanos y la facultad conferida por la Constitución al legislador para promulgar leyes especiales en función de la naturaleza de la situación.““ vi Finalmente, se emplearon métodos de investigación jurídica para abordar el tema y contrastar la hipótesis. Los resultados se presentaron de manera concluyente, y se recopilaron en las conclusiones. Este trabajo se llevó a cabo como una investigación descriptiva-dogmática, sin requerir el uso de una población y muestra específica

Regarding the objectives, the following were proposed: (i) to analyze the criminal offense of homicide in the national legislation, taking into consideration the statement of reasons regarding its social significance, (ii) to establish the primary duties of the State from a constitutional perspective, considering the integral development of society as a foundation, (iii) to explain the authority granted by the Constitution to the legislator to enact special laws as necessitated by the circumstances. Subsequently, the hypothesis was formulated as follows: ““The legal and constitutional foundations that would support the regulation of criminal liability from the age of sixteen for the offense of homicide in the Peruvian Penal Code include the State's constitutional duty to protect its citizens and the authority granted by the Constitution to the legislator to enact special laws based on the exigencies of the situation.““ viii Finally, legal research methods were employed to address the topic and test the hypothesis.
