description El objetivo de la presente tesis ha sido el de identificar los fundamentos que sustentarán la incorporación legal de la maternidad subrogada en el ordenamiento jurídico peruano y así garantizar el derecho de reproducción. En de las mujeres infértiles. En base a los problemas jurídicos y sociales, se ha determinado que los fundamentos son: el respeto a los derechos constitucionales como el derecho a la igualdad, a la libertad, al acceso a prestaciones de salud, etc; el ejercicio pleno de los derechos sexuales y reproductivos, así como el derecho hijos, a la salud reproductiva y libertad reproductiva; la protección al proyecto de vida de mujeres infértiles, el principio a la no discriminación de los padres intencionales, el principio protector de la familia y el principio del interés superior del niño. El tipo de investigación es cualitativa, con un nivel correlacional y diseño no experimental transversal correlacional. En esta investigación se ha analizado minuciosamente el derecho comparado y la doctrina tanto nacional como internacional y se ha tomado como muestra a ocho mujeres infértiles y diez abogados sobre los que se aplicó la técnica de la entrevista y dio como resultado una respuesta favorable a la propuesta de investigación y reafirmó la urgente necesidad de su regulación en la legislación nacional.

Based on the legal and social problems, it has been determined that the foundations are: respect for constitutional rights such as the right to equality, freedom, access to health benefits, etc.; the full exercise of sexual and reproductive rights, as well as the right to children, reproductive health and reproductive freedom; the protection of the life project of infertile women, the principle of non discrimination of intended parents, the principle of protection of the family and the principle of the best interest of the child. The type of research is qualitative, with a correlational level and non-experimental cross-sectional correlational design.
