The investigation starts from having observed and perceived that many times the giving of laws is quite far from reality; Therefore, when it is intended to control and / or accelerate certain processes, without having studied reality, instead of contributing they end up increasing the problem. Thus, our research is based on the analysis of Law No. 30364, specifically in the terms granted by the Law to prevent, punish and eradicate violence against women and members of the family group. The main objective of the thesis is to determine the legal consequences of the application of the terms granted by Law N ° 30364 - Law to Prevent, Punish and Eradicate Violence against Women and Members of the Family Group - to members of the Police National of Peru (24 hours) and Family Courts (72 hours); in order to establish its objectivity, effectiveness and guarantee due process, both in the preliminary stage and in the protection stage; objective to be achieved from the analysis of the real national context. For this our research has been developed based on specific cases; as well as, conducting interviews with police and judicial authorities, aware of the subject, that can give us a broad picture of the legal advantages and disadvantages of the application of Law No. 30364 with respect to the terms that it grants for the granting of a measure of protection in a case of family violence. In short, our thesis aims to demonstrate the impossibilities that have arisen both in the police and jurisdictional, for having deadlines away from all reality.
