La presente investigación trata sobre los divorcios por la causal de separación de hecho y la indemnización al cónyuge perjudicado cuya muestra de estudio corresponde a los Juzgados de Familia de la Corte Superior de Justicia de Ica; en cuanto a una de las causales objetivas es preciso señalar que con fecha 07 de Julio del 2001, se encuentra vigente la Ley 27495, mediante la cual la Legislación Peruana fortalece el sistema mixto considerado divorcio remedio y divorcio sanción de separación de cuerpos, adicionando dos nuevas causales, basadas en la quiebra o fracaso matrimonial: La separación de hecho y la imposibilidad de hacer vida en común. El divorcio relativo o separación convencional es conocida en nuestra legislación como separación de cuerpos. Consiste en la relajación del vínculo conyugal, por la cual los cónyuges se separan de lecho y habitación, poniendo término a la vida en común, cesando los deberes matrimoniales, especialmente el de cohabitación, subsistiendo el vínculo conyugal, no pudiendo ambos contraer nuevo matrimonio por estar vigente el deber de fidelidad. El divorcio absoluto, también conocido como divorcio vincular, consiste en la disolución total, definitiva y perpetúa del vínculo conyugal. Es declarado por la Autoridad Judicial competente, teniendo como principal efecto el poder de contraer nuevas nupcias. ----- The present investigation deals with divorces due to de facto separation and compensation to the injured spouse whose study sample; corresponds to the Family Courts of the Superior Court of Justice of Ica Regarding one of the objective causes, it should be noted that on July 8, 2001, Law 27495 is in force, through which the Peruvian Legislation strengthens the mixed system considered divorce remedy and divorce sanction of separation of bodies, adding two new grounds, based on bankruptcy or marital failure: De facto separation and the impossibility of living together. The relative divorce or conventional separation is known in our legislation as corporate separation. It consists of the relaxation of the conjugal bond, by which the spouses separate their bed and room, putting an end to life in common, ceasing the marital duties, especially that of cohabitation, subsisting the conjugal bond, both being unable to contract a new marriage for the duty of fidelity is in force. Absolute divorce, also known as bonded divorce, consists of the total, final and perpetual dissolution of the marital bond. It is declared by the competent Judicial Authority, having as main effect the power to remarry.
