Con sumo cuidado, podemos señalar que en nuestro sistema jurídico no se encuentra aún bien definido ni reglamentado bajo qué criterios, normatividad, factores, tablas, etc., los señores magistrados deben establecer y ordenar el pago por concepto de reparación civil a favor de las menores, a sus madres o apoderadas que han sufrido el abandono o falta de manutención por parte de sus padres o progenitores, a fin de cubrir todo el daño causado por el incumplimiento de la manutención. Pero, trataremos de algún modo posible las acciones adoptadas por el Ministerio Público que tampoco cuenta con un sistema adecuado para solicitar dicha indemnización, limitándose en la mayoría de los casos al criterio del magistrado o en todo caso al tiempo transcurrido del periodo liquidado o tal vez al monto de la pensión devengada que se viene tramitando por ante el Poder Judicial en la vía penal; motivo por el cual mi interés por desarrollar la investigación “Criterios del Juez y Fiscal para aplicar el pago por concepto de reparación civil en omisión a la asistencia familiar en el Poder Judicial del distrito de Ica, periodo: 2019”. Procedemos a desarrollar los antecedentes internacionales, nacionales y locales, para así tener una antesala del tema tratado. Luego el Planteamiento del Problema, Problema General, Problemas Específicos. De igual manera, la justificación e importancia de la investigación. Acto seguido, los objetivos de la investigación, Objetivo General y Específicos. Seguidamente, las Hipótesis de la investigación, hipótesis General, hipótesis específicas y por último se desarrollan las variables de investigación en todas sus dimensiones, identificación y operacionalización de variables. Asimismo, en la Estrategia Metodológica se desarrolla el tipo, nivel y diseño de la investigación, la población con su respectiva muestra; además de las Técnicas e instrumentos de investigación, se procede a desarrollar las técnicas de recolección de datos, los instrumentos de recolección de datos y técnicas, análisis e interpretación de información y en la Contrastación de Hipótesis, se desarrolla la comprobación de la hipótesis general, así como la comprobación de las hipótesis específicas. Por último, en el apartado III se desarrolla los resultados obtenidos, en el apartado IV la Discusión de los resultados, en el V las Conclusiones y finalmente en el apartado VII las Recomendaciones, anexo, entre otros. ----- With great care, we can point out that in our legal system it is not yet well defined or regulated under what criteria, regulations, factors, tables, etc., the judges must establish and order the payment of civil reparation in favor of the minors, their mothers or guardians who have suffered abandonment or lack of support by their parents, in order to cover all the damage caused by noncompliance with support. We proceed to develop the international, national and local background, in order to have a prelude to the topic discussed. Then the Statement of the Problem, General Problem, Specific Problems. Likewise, the justification and importance of the research. Next, the objectives of the research, General and Specific Objectives. Next, the research hypotheses, general hypothesis, specific hypotheses and finally the research variables are developed in all their dimensions, identification and operationalization of variables. Likewise, the Methodological Strategy develops the type, level and design of the research, the population with its respective sample; In addition to the research techniques and instruments, the data collection techniques, data collection instruments and techniques, analysis and interpretation of information are developed, and in Hypothesis Testing, the verification of the general hypothesis is developed. as well as the verification of specific hypotheses. Finally, in section III the results obtained are developed, in section IV the Discussion of the results, in section V the Conclusions and finally in section VII the Recommendations, annex, among others.
