Se ha tomado en cuenta desde el punto de vista legal para su realización, lo establecido en la Constitución Política del Perú de 1993; la Ley 30220, Ley Universitaria; el Estatuto de la UNICA; Normatividad Legal Penal y Procesal Penal; la Resolución Rectoral 029-2021-4, Líneas de Investigación UNICA; la Resolución Rectoral 048-2021-R, Reglamento de Grados y Títulos de la UNICA y la Resolución Rectoral 1320-2021-R, Guía para la Elaboración del Proyecto, Informe Final de Tesis UNICA. En el proceso de recolección de datos se recurrió a las Técnicas de la Encuesta, del Análisis Documental y a sus correspondientes instrumentos: Cuestionario sobre Delito de Genocidio y Guía de Análisis Documental sobre la Teoría Mediata en el Perú. De los resultados obtenidos se deduce que: Entre muerte a personas de un determinado grupo y utilización de otra persona como medio o instrumento en el Perú al año 2023, existe una relación muy estrecha; entre lesión grave a la integridad física de miembros de un grupo y actuación inconsciente de la persona en el Perú al año 2023 existe una relación muy importante; entre delito de genocidio y teoría mediata en el Perú al año 2023, existe una relación significativa.

From a legal point of view, the provisions of the Political Constitution of Peru of 1993; Law 30220, University Law; the Statute of UNICA; Criminal Legal Regulations, Criminal Procedure; Rectoral Resolution 029-2021-4, UNICA Research Lines; the Rectoral Resolution 048-2021-R, Regulations of Degrees and Titles of the UNICA and the Rectoral Resolution 1320- 2021-R, Guide for the Preparation of the Project, Final Report of the UNICA Thesis. In the data collection process, the Survey Techniques, the Documentary Analysis and their corresponding instruments were used: Questionnaire on the Crime of Genocide and Guide to Documentary Analysis on Mediate Theory in Peru.
