Descripción
Sumario:This research examines the classification and prosecution of economic or patrimonial violence in the Peruvian legal framework -principle of legality-. Through qualitative interviews with legal experts and an exhaustive review of current legislation, a significant omission was identified in the Peruvian Penal Code regarding economic or patrimonial violence. The findings reveal that this omission contributes to the perpetuation of violence and insufficient legal protection for victims, negatively affecting trust in the justice system and social cohesion. The research supports the general hypothesis that the absence of a clear and specific classification leads to inconsistent application of the law and a minimization of the impact of this type of violence between justice operators and society. The implementation of specific legislative reforms, the development of clear guidelines and specific protocols, and the promotion of greater public awareness are recommended. These actions are essential to improve the effectiveness of the legal system in dealing with economic or property violence and to guarantee the protection and rights of all people in Peruvian society.
