Departamento Académico de Ingeniería Ambiental, Física y MeteorologíaDebido a las necesidades de establecer mecanismos ambientales regulatorios para los proyectos de inversión en todo el Perú, el Estado dispuso la creación del Sistema de Evaluación del Impacto Ambiental, el cual a través de su reglamento brindó los lineamientos para el proceso y desarrollo de Instrumentos de Gestión Ambiental para las Categorías I, II y III, así como sus modificaciones y actualizaciones. Posteriormente, bajo la necesidad de los inversionistas de legalizar frente al Estado cambios menores en sus proyectos, se emitió el Decreto Supremo Nro. 054 - 2013 - PCM, que brindó la posibilidad de emitir Informes Técnicos Sustentatorios. En el año 2012, el Estado Peruano creó el Servicio Nacional de Certificación Ambiental para las Inversiones Sostenibles (SENACE), un organismo parte del Ministerio del Ambiente, el cual tiene por función principal clasificar los proyectos de inversión y evaluar los Instrumentos de Gestión Ambiental de Categoría III, así como otros instrumentos ligados a proyectos con Categoría III. Los proyectos de inversión en los sectores mineros y eléctricos cuentan con un sistema de Instrumentos de Gestión Ambiental relativamente ordenado con diferentes escalas, de acuerdo a la magnitud de los impactos. Sin embargo, este sistema tiene falencias, siendo las principales para el autor de la presente monografía el incumplimiento de los tiempos establecidos por la normatividad ambiental a la hora de la clasificación y obtención de la Certificación Ambiental y los deficientes Términos de Referencia comunes aprobados para los sectores minero y eléctrico. Se considera necesario que el nuevo ente de certificación ambiental, SENACE, deba coordinar e integrar los lineamientos de evaluación ambiental para todos los proyectos de inversión. Además deber ser prioridad la implementación de lineamientos para el desarrollo de ITS en el sector eléctrico y las actualizaciones y modificaciones de Instrumentos de Gestión Ambiental.Due to the need to establish regulatory environmental mechanisms for investment projects throughout Peru, the Government ordered the creation of the Environmental Impact Assessment System, which, through its regulations, provided the guidelines for the process and development of Documents for Environmental Management for Categories I, II and III, as well as their modifications and updates. Subsequently, under the need of investors to legalize minor changes in their projects with the Government, Supreme Decree Nro. 054 - 2013 - PCM was issued, which provided the possibility of issuing Sustainability Technical Reports. In 2012, the Peruvian Government created the National Environmental Certification Service for Sustainable Investments (SENACE), a branch of the Ministry of the Environment, whose main function is to classify investment projects and evaluate the Environmental Management Instruments of Category III, as well as other instruments linked to Category III projects. Investment projects in the mining and electric sectors have a relatively ordered system Environmental Management Documents with different scales, according to the magnitude of the impacts. However, this system has shortcomings, the main ones for the author of this monograph being the failure to comply with the times established by environmental regulations at the time of classification and obtaining the Environmental Certification and the deficient common Guidelines for Report Preparation approved for the mining and electric sectors. It is considered necessary that the new environmental certification organism, SENACE, should coordinate and integrate the environmental assessment guidelines for all investment projects.
