La investigación es tipo básica y cualitativa, se realizó entrevistas a 15 abogados, colegiados y habilitados, con 5 años de experiencia. Es un muestreo por conveniencia, y un análisis de teoría fundamentada. Se determinó que existe afectación patrimonial del conviviente por su desconocimiento, aportando al patrimonio común, pero sin acceso a derechos, además la jurisprudencia es limitada, las teorías que lo defienden se basan en la esencia de la convivencia como la buena fe; y el Derecho Comparado ofrece nuevas figuras jurídicas hacia la normativa peruana.
