description El presente estudio académico se alineó con el ODS N° 17 (Alianzas para lograr objetivos) y tuvo como objetivo general determinar los desafíos legales en la protección de los derechos de autor respecto a las creaciones generadas por inteligencia artificial en el ordenamiento jurídico peruano. En cuanto a la metodología empleada, se mantuvo un enfoque cualitativo, de carácter básico y con un diseño de investigación de teoría fundamentada y fenomenológico, involucrando a 12 especialistas en Propiedad Intelectual y Derecho Constitucional. Los hallazgos revelaron la ausencia de un marco regulatorio y las dificultades para adaptar la normativa ante el rápido avance de la IA, lo que llevó a concluir que es urgente adoptar un enfoque interdisciplinario. Se destacó la necesidad de abordar futuros problemas legales, incluyendo la incertidumbre sobre la titularidad de derechos de autor, la originalidad de las obras generadas con IA y la vulneración de derechos. Además, se enfatizó en contar con más casos prácticos que guíen la regulación nacional y optimizar la capacidad técnica del INDECOPI para garantizar una respuesta efectiva ante las complejidades legales que surgen en la era digital.
