description El contenido de la presente tesis abarca desde la introducción, con la realidad problemática, de que hoy en día existen seres humanos que por causa de la complexión o factores inmunológicos no pueden concebir, y quisieran procrear con métodos de reproducción asistida como la inseminación artificial o la fecundación in vitro, el problema incluye que el no consentimiento de alguno de los cónyuges configura un hecho deshonesto y muy poco moral dentro de la sociedad conyugal, el presente estudio abarca como objetivo general determinar si la reproducción artificial sin consentimiento del cónyuge se puede utilizar en virtud al fundamento para el posible trámite de divorcio por injuria grave, que se repercutiría a nivel nacional, las teorías en que se enmarca principalmente son, la reproducción artificial; el matrimonio; familia: el divorcio e injuria grave, la población abarca a los jueces de familia y abogados especialistas en derecho de familia de la ciudad de Chiclayo, los instrumentos empleados fueron preguntas tipo cuestionario.
