Además, es de enfoque cualitativo con tipo de investigación básica y el diseño jurídico descriptivo. Habiendo utilizado las técnicas de investigación como entrevista, análisis documental, ficha de entrevista y ficha de análisis documental. Y, como resultado principal se obtuvo que, es necesaria la incorporación normativa de la maternidad subrogada, con el objetivo de erradicar aquel vacío legal que genera este problema, asimismo la regulación de la maternidad subrogada garantiza el derecho a la familia, el derecho a ser madre. Concluyendo que, es de vital importancia incorporar la maternidad subrogada al Código Civil Peruano.
