Este trabajo de investigación se enfoca en explorar cómo se ha establecido el concepto de legítima y libertad testamentaria en el contexto legal del Perú y cómo estas regulaciones impactan en la sucesión y los derechos de los herederos. Por ello se planteó como objetivo general determinar de qué manera la legítima limita la libertad testamentaria en la legislación peruana, 2023. La metodología de la investigación tuvo un enfoque cualitativo, tipo básica y diseño de teoría fundamentada. Las técnicas de recolección de datos fueron la entrevista y el análisis documental, con instrumento de la guía de entrevistas y la guía de análisis documental donde se trasladaron los datos de los especialistas respecto al tema de investigación y las fuentes documentales. Obteniéndose como resultado que la legítima está limitando la libertad testamentaria, ya que de manera imperativa los testadores tienen que otorgar una porción de su herencia a sus herederos forzosos.
