El tipo de investigación es básica con enfoque cualitativo basada en teoría fundamentada y bibliográfica. La técnica de recolección de datos es el análisis documental y entrevista. Por lo cual, se llegó a la conclusión de que la prisión preventiva no afecta el derecho a la presunción de inocencia del investigado en el Perú, pero al analizar el primer presupuesto de existencia de graves y fundados elementos de convicción se relaja la garantía, pues se está prejuzgando al imputado sobre su culpabilidad, por ello el análisis de los medios de prueba se debe dar en el juicio oral, lo que se debería analizar en la audiencia de prisión preventiva es el arraigo en el país del investigado y la existencia del peligro de fuga y obstaculización del proceso para así garantizar la presunción de inocencia.
