Además, partió con el objetivo general de determinar que existe la necesidad de modificar el artículo 150 del Código Penal, suprimiendo la frase “y que se halla en situación crítica”. Asimismo, se trata de una investigación cualitativa, básica, descriptiva, no experimenta, que utilizó los siguientes métodos: inductivo, comparativo y el análisis. Entre los instrumentos de recolección de datos, se tiene a la ficha de revisión bibliográfica, así como a la guía de entrevista por objetivos; la muestra estuvo conformada por ocho operadores del sistema de justicia que, al tratarse de investigación cualitativa, solo fueron para complementar la parte teórica; el muestreo ha sido no probabilístico intencionado.
