El problema general establecido es el siguiente: ¿de qué manera se debe regular la imprescriptibilidad del delito de contaminación ambiental para la tutela adecuada, en el Código Penal Peruano?, como método de investigación, se ha empleado el de carácter inductivo y deductivo, como tipo de investigación se ha indicado el siguiente: investigación básica. El nivel de investigación es de carácter explicativo. Utilizando la guía de entrevista como instrumento. A nivel de resultados, se indica que la prescripción de los delitos contra el medio ambiente es causa de que se hayan incrementado notablemente los delitos contra el medio ambiente. Como conclusión se plantea lo siguiente: se ha determinado que se debe regular la imprescriptibilidad del delito de contaminación ambiental para la tutela del derecho a un medio ambiente sano y equilibrado, en el Código Penal Peruano.
