The objective of this research work is to study the Best Interest of the Child and the legal difficulties in accessing regularization due to migratory quality by Venezuelan migrant children and adolescents in an irregular situation. As a starting point, the historical and legal evolution of childhood is developed, followed by the aforementioned Best Interest of the Child, presenting it in its triple dimension as a right, as a legal principle and as a procedural rule. In addition to this, the protection standards that migrant children in an irregular situation have, both international and national, are exposed, as well as the basic rights that are most affected, being specifically identified: health and education. This limitation of rights is directly linked to migratory regularization. In order to contrast all the above theoretically and determine if the authority takes into account the ISN in the regularization processes, interviews were conducted with experts, resulting in the conclusions and recommendations developed in the last pages of this thesis.
