En la presente tesis fundamentaremos una problemática de índole social y jurídica, existe un vacío legal en nuestra normativa nos referimos a la Indemnización por daño moral al hijo no reconocido. Analizaremos si es posible el pago de una indemnización por parte del progenitor ante su omisión de reconocer voluntariamente a su hijo asimismo de resarcir el daño. El daño moral ocasionado es difícil cuantificarlo porque se trata de la esfera interna de una persona, proponemos qué aspectos tomar en cuenta para cuantificarlo y a la vez sancionar la omisión del padre biológico a su deber en reconocer a su hijo voluntariamente. Como solución a nuestro problema y vacío legal planteamos una propuesta legislativa a favor del hijo no reconocido. |

Como solución a nuestro problema y vacío legal planteamos una propuesta legislativa a favor del hijo no reconocido.In this thesis we will base a problematic of social and legal nature, there is a legal vacuum in our regulations we refer to the compensation for moral damages to the unrecognized child. We will analyze if it is possible the payment of compensation by the father to his failure to voluntarily recognize his child also to repair the damage done and offering restitution. The moral damage caused is difficult to quantify because it is the internal sphere of a person, we propose what aspects to take into account to quantify it and at the same time to sanction the omission of the biological father to his duty to recognize his child voluntarily.
