| Sumario: | In this article, the author intends to propose a statute of rights and obligations of the property owner, within the framework of the social function of property. Previously, he will determine if the social function of property is recognized at constitutional or legal level in the Peruvian legal system. The author highlights the importance of the recent enactment of Law N° 31313, Sustainable Urban Development Law. However, he urges to reflect on the need to improve this normative instrument with regard to the rights and obligations of the owner. The foregoing, given the need to resolve a fractional legislation and little specialized in the matter. |
